 The land is classified as Grade 1 Agricultural Land on the DEFRA Agricultural Land Classification Map of England and Wales. The soil classification of this land is Soilscape 21 – Loam and Clay Soils of coastal flats with naturally high groundwater (Romney series).

Tenure

The Tenure is Freehold with vacant possession on completion.

Access

The land has a good vehicular access from the west side of the B1515 Fleet Road, Fleet Hargate at the former Washway Road Corner.

The field was registered with the Rural Payments Agency under NG 1812 and the last claim made under the Basic Payment Scheme was 2018.  No further details are available in respect of the scheme in so far as the property is concerned and no Entitlements will pass with the sale of the land.

Environmental Stewardship Scheme

To the best of our knowledge the land has not been entered into an Environmental Stewardship Scheme(s).

Tenantright and Dilapidations

There will be no charge for Tenantright made by the outgoing Owner or Occupier and in return the Purchaser(s) will make no claim whatsoever for Dilapidations (if any) against the Vendors or the outgoing Tenant(s)

Rights of Way

We are not aware of any Rights of Way over the property to be sold.

As the watercourses to the East and North-West boundaries are un-registered they are considered under riparian ownership and any Purchaser would be considered owner(s) to the centreline of each watercourse and would have responsibility to ensure that each watercourse is kept clear. These watercourses are not adopted by the Board and therefore not subject to Byelaw 10, however, along with adopted watercourses, riparian watercourses are protected under Section 23 of the Land Drainage Act, 1991 (and Byelaw 4) and as such no works are permitted to alter the watercourse without land drainage consent from the South Holland Internal Drainage Board. Furthermore, any introduction of water to a watercourse (surface water or treated foul) would require consent under Byelaw 3

Quotas and Contracts

There are no contracts or quotas passing with the land.

The vendor has confirmed that the Sporting Rights are included in the sale.

 The land will be sold subject to all rights of way, public or private, and all easements and wayleaves where applicable.

Overage Clause

The Vendors will claim the benefit of an uplift/overage provision of all or part of the land parcel(s) being sold should the land use change from its current agricultural status for a period of 20 years from the date of completion of the sale with the percentage of uplift being 25% over and above the existing land value at that time.  The uplift/overage clause will be activated by the implementation of planning consent or all or part of the land parcels being sold with the benefit of planning consent.

Value Added Tax

In the event of a sale of the land or any rights attached to it becoming a chargeable supply for the purposes of VAT, such Tax will be payable by the Purchaser(s) in addition to the purchase price.
