VALUE ADDED TAX

In the event of a sale of the land or any rights attached to it becoming a chargeable supply for the purposes of Value Added Tax, such Tax will be payable by the Purchaser(s) in addition to the purchase price.

COMPLETION OF THE SALE

Following crop clearance early possession can be arranged upon exchange of contracts and the appropriate legal arrangements being made.

RURAL PAYMENTS AGENCY BASIC PAYMENT SCHEME

  • The lands are registered on the Rural Land Register for the purposes of the Basic Payment Scheme and the vendors and their outgoing tenant will retain the full benefit of the 2019 RPA Basic Payment.  The Purchaser(s) will be required to indemnify the vendors for any non cross compliance that results in any penalty or reduction in the Basic Payment receivable by the vendors or the Outgoing Tenant up to and until 31st December 2019.
  • No Basic Payment Entitlements will pass with the sale of the land.

WAYLEAVES, EASEMENTS AND RIGHTS OF WAY

The land will be sold subject to any Wayleaves, Easements and Rights of Way whether or not they are known to exist.

These are included in the sale as owned by the vendors subject to any statutory exclusions.

TENDER DETAILS

Prospective Purchaser(s) wishing to submit an Informal Tender are requested to complete the relevant Tender Form for each of the Lots attached to these particulars and return it sealed in the envelope provided to arrive at the Auctioneers Offices at or before 5.00pm on

 TUESDAY 30TH JULY 2019

 

  • No escalating bids will be accepted.
  • The Vendor reserves the right not to accept any particular Informal Tender or the highest Informal Tender received.
  • Should the Informal Tender be subject to borrowings or the sale of any other property then full details should be given and confirmation of any agreed borrowings provided.
  • All Tenders will be received ‘Subject to Contract’ and will be acknowledged following the Closing Date and Time for submission of Informal Tenders. A further letter will be dispatched by

WEDNESDAY 7TH AUGUST 2019

 notifying Tenderer(s) whether or not his/her/their Tender has been successful.  The Successful Tenderer will then be required to pay straightaway, Subject to Contract, a ten per cent (10%) deposit upon the amount of the accepted Informal Tender to the Vendor’s Agents and details of the sale and purchase will be advised to both the Vendor’s and the Purchaser(s) Solicitors.

WITH VACANT POSSESSION UPON COMPLETION

Early Possession prior to completion may be taken by arrangement.
